PROVISIONS SPECIFIC TO .QPON REGISTRATIONS
dotCOOL, Inc. (“Registry Operator”) is the registry operator for the .QPON TLD.
Registry Operator’s Reservation of Rights. Registry Operator reserves the right to deny, cancel, place on registry-lock or hold, or transfer any registration that it deems necessary, in its discretion; (1) to protect the integrity, security and stability of the Internet or registry; (2) to comply with any applicable laws, government rules or requirements, requests of law enforcement or any other relevant authority or in compliance with any dispute resolution process; (3) to avoid any liability, civil or criminal, on the part of Registry Operator and Neustar, Inc. and their affiliates, subsidiaries, subcontractors, officers, directors, employees and stockholders; (4) for violations of the registry-registrar and its exhibits; (5) to correct mistakes made by Registry Operator or any registrar in connection with a domain name registration; (6) to ensure compliance with ICANN and/or Registry Operator policies and/or procedures; (7) for the non-payment of fees to Registry Operator; and/or (8) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs). Registry Operator also reserves the right to lock or place on hold a domain name during resolution of a dispute. Registry Operator reserves the right to take immediate action to remove orphan glue records (as defined at http://www.icann.org/en/committees/security/sac048.pdf) when provided with evidence in written form that such records are present in connection with malicious conduct.
AUP and TOS. You shall comply with Registry Operator’s Acceptable Use policies and Terms of Service, as they may be instituted or updated from time to time and published on the Registry Operator website.
Personal Data. You consent to the collection and use of your personal data by Registry Operator.
Indemnification. You shall indemnify, defend and hold harmless the Registry Operator and Neustar, Inc. and their subcontractors, subsidiaries, affiliates, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors and assigns, from and against any and all claims, demands, damages, losses, costs, expenses, causes of action or other liabilities of any kind, whether known or unknown, including reasonable legal and attorney’s fees and expenses, in any way arising out of, relating to, or otherwise in connection with your domain name registration. This indemnification obligation will survive the termination or expiration of the Agreement.
Compliance with Terms and Conditions and Operational Compliance. You shall comply with all of the following requirements:
(a) ICANN standards, policies, procedures, and practices for which Registry Operator has responsibility in accordance with the Registry Agreement.
(b) Operational standards, policies, procedures, and practices for the .QPON TLD as set forth in the Registry Agreement and as established from time to time by Registry Operator, including affiliates of Registry Operator, and consistent with ICANN's standards, policies, procedures, and practices and the Registry Agreementt, as applicable.
