PROVISIONS SPECIFIC TO .RICH REGISTRATIONS
I-REGISTRY Ltd. (“Registry Operator”) is the registry operator for the .RICH TLD.
Personal Data. You consent to Registry Operator’s collection and use and disclosure of your personal data.
Registry Policies. You shall adhere to and comply with Registry Policies adopted by Registry Operator in relation to the .RICH TLD. You understand that the English version governs and the other language versions are provided for convenience only.
Indemnification. You acknowledge and agree that (i) you are fully responsible for the registration and use of the registered domain name; and that (ii) you shall indemnify, to the maximum extent permitted by law, defend and hold harmless Registry Operator, Registry Operator’s service providers, Registry Operator’s shareholders, and Registry Operator’s directors, officers and employees and agents from and against any claim, damages, liabilities, costs and expenses (including reasonable lawyer fees) arising out of or relating to your domain name registration and/or use.
Registration Information. You must immediately correct and update the registration information for the registered name during the registration term.
Resolution of Disputes. You shall adhere and comply with all applicable ICANN Policies and Registry Policies for resolution of disputes concerning domain names. In addition, you acknowledge having read and understood and agree to be bound by the terms and conditions of the following documents, as they may be amended from time to time, which are hereby incorporated and made an integral part of this Agreement:
•The Uniform Domain Name Dispute Resolution Policy, available at http://www.icann.org/en/help/dndr/udrp/policy;
•The Uniform Rapid Suspension Procedure and Rules, available at http://newgtlds.icann.org/en/announcements-and-media/announcement-05mar13-en; and
•The Transfer Dispute Resolution Policy, available at http://www.icann.org/en/help/dndr/tdrp.
Applicable Laws. You must provide accurate contact information as well as comply with all applicable rules and laws including those that relate to privacy, data collection, consumer protection, import/export of services and disclosure of data.
Registry Operator’s Anti Abuse Policies and Terms of Service. You shall comply with Registry Operator’s Anti Abuse policies and Terms of Service, if any, as they may be instituted or updated from time to time and published on the Registry Operator website.
Third Party Beneficiary. Registry Operator is a third party beneficiary of the Agreement and is entitled to enforce its rights vested by the Agreement. Such vested rights include those pertaining to compliance, validity, security, URS/UDRP, misuse/abuse cases or issues, and also the contact with regard to charity activities. The rights in these cases or issues vested in Registry Operator as beneficiary of the Agreement shall survive the termination or expiration of the Agreement.
Registry Operator’s Reservation of Rights. Registry Operator and Registry Operator service providers acting on behalf of Registry Operator reserve the right to change the status of the domain name during the resolution of a dispute, the investigation of an abuse, a compliance procedure, or upon a request from a competent authority (e.g. put on a hold, lock, deactivate, deregister, and/or delete), as well as to deny, modify, cancel or transfer any registration that Registry Operator deems necessary, in its sole discretion, in order to:
- protect the integrity, security, and stability of the Registry System or the DNS in general;
- comply with all appropriate laws, government rules or requirements, requests of law enforcement or any other relevant authority, or in compliance with any dispute resolution process;
- avoid any liability of Registry Operator, its affiliates, members, subsidiaries, officers, directors, and employees;
- stop or prevent any violations of any terms and conditions of this Agreement;
- correct mistakes made by Registry Operator, Registry Operator service providers or any registrar in relation to a domain name registration; and
- ensure compliance with ICANN and/or Registry Policies.
Order of Precedence. To the extent that any provision of these additional provisions contravenes the provisions of the Agreement, these additional provisions shall prevail.
